This website is owned and operated by CSH Group Pty Ltd trading as Shaped (ABN 44 648 874 882) ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website, shaped.com.au, and any related services, including enquiries, proposals and communications ("Services").
By using our website, you agree to be bound by these Terms and our Privacy Policy. If you do not accept these Terms, you must not use our Services.
1. Use of our website
You may use our website for lawful purposes only. You must not:

- Interfere with the operation of the website or servers

2. Enquiries and proposals
Our website allows you to send us an enquiry, book a call, or answer a short questionnaire about your business. When you do:
- You agree to provide accurate and complete information about your business and the process you want help with
- Any price shown on the website, or produced by the questionnaire, is a starting point for scoping and may change once we have reviewed your requirements
- Proposals are not binding until formally accepted in writing by both parties
We reserve the right to decline an enquiry at our sole discretion.
These Terms apply to all the services that are displayed on our website at the time you access it. All information, descriptions and examples that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions or examples, and outcomes described for one client are not a promise of outcomes for another.
3. Engagements and payment
If you accept a proposal and engage our services, a separate written agreement applies. It will set out, among other things:
- Scope, deliverables and acceptance
- Deposit, milestone and payment terms
- Timelines and the inputs we need from you
- Where your data lives and which AI providers, if any, process it
- Intellectual property in what we build
- Cancellation or variation conditions
Where these Terms and a written agreement differ, the written agreement prevails. Payment terms will be outlined in your agreement or invoice. Unless otherwise agreed, payment is due according to the terms stated on your invoice.
4. Timelines
We will make reasonable efforts to meet agreed timelines; however, delivery may vary based on:
- Timely access to your systems, data and people
- Changes in scope
- Availability and behaviour of third-party platforms and AI providers
- Supplier or service outages outside our control
Delays outside of our control will not constitute a breach of these Terms. We are not liable for consequential loss arising from delays.
5. Warranties and Australian Consumer Law
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL). You are entitled to certain guarantees under the ACL that cannot be excluded, including that services will be carried out with due care and skill.
To the extent permitted by law:
- We disclaim all warranties, express or implied, except those required under the ACL
- Our liability is limited, at our discretion, to re-performing the services or refunding the amount paid
6. Intellectual property
All content on our website, including text, images, logos, designs and layouts, is owned by or licensed to us and is protected by intellectual property laws. You may not reproduce, modify, or distribute any part of our content without our express permission.
Names of third-party platforms and products mentioned on this website (for example monday.com, Make, Anthropic, OpenAI) are trademarks of their respective owners. Mention of a platform does not imply a partnership, certification or endorsement unless we say so explicitly.
